Frequently asked questions

What should I check before buying property?

At a minimum: the chain of title documents, the encumbrance certificate, patta and revenue records, approvals for the layout or building, tax receipts and the identity of the seller. A written legal opinion before paying an advance is strongly advisable.

How do I transfer patta after buying land?

After registration, an application for patta transfer is made to the revenue department, usually online, with the registered deed and supporting documents. It should be followed up until the revenue records show the new owner.

What can I do if the builder has delayed handing over my flat?

Depending on the facts, a homebuyer can approach the Real Estate Regulatory Authority, the Consumer Commission or the civil court for possession, refund with interest or compensation.

Can an NRI buy or sell property in India through a power of attorney?

Yes. A power of attorney executed abroad must be properly attested, and must be presented for stamp duty within the prescribed time after it is received in India before it is used for registration.
