Frequently asked questions
Is registration of a Will compulsory?
No. Registration of a Will is optional, but a registered Will is generally easier to prove. A Will must be signed by the testator and attested by at least two witnesses.
What is the difference between a gift deed and a settlement deed?
Both transfer property without consideration. In Tamil Nadu, a settlement deed is commonly used to transfer property to family members and may attract concessional stamp duty. The right document depends on the relationship and purpose.
Does a rental agreement need to be registered?
Leases of immovable property from year to year, or for a term exceeding one year, require registration. Shorter tenancies should still be in writing, and in Tamil Nadu tenancy particulars are to be intimated to the Rent Authority.
Can an agreement for sale be cancelled?
An agreement for sale can be cancelled by mutual consent. Unilateral cancellation may lead to a claim for specific performance or refund, depending on the terms and the conduct of the parties.
