Which Consumer Commission should I approach?
It depends on the value of the goods or services paid for. District Commissions hear complaints up to ₹50 lakh, State Commissions above ₹50 lakh and up to ₹2 crore, and the National Commission above ₹2 crore. A complaint may generally be filed where you reside or work, or where the opposite party carries on business.
What is the time limit to file a consumer complaint?
A complaint should ordinarily be filed within two years from the date on which the cause of action arose. Delay can be condoned only if sufficient cause is shown, so it is best to act early.
Is there a fee to file a consumer complaint?
Fees are prescribed on a slab basis according to the value of the goods or services. For complaints up to ₹5 lakh, no fee is currently payable.
Can I claim compensation for mental agony?
Yes. Apart from refund or replacement, Consumer Commissions can award compensation for loss, injury, mental agony and harassment, along with litigation costs, depending on the evidence placed on record.
